AQUATOTS TERMS & CONDITIONS
Please read these terms and conditions prior to completing your booking documentation.

Information Accuracy.
Aquatots endeavours to ensure that all the information provided in our documentation or communicated by other mediums such as our web site, www.aquatots.com is accurate. However, there may be times that advertised facilities or amenities may not be continuously or fully available. Where we are aware of any changes following the receipt of your completed booking documentation and payment, and if the changes are likely to seriously affect your booking, we will make every effort to inform you prior to the start of your confirmed term or session(s).

Our agreement with you.
Your agreement with Aquatots shall be considered to be in affect upon receipt of your completed booking form, signed Assumption of Risk Agreement and payment. We will thereafter forward written confirmation of the booking and all relevant information to you prior to the start of the related term.

The 7 day deadline.
Following your initial contact, Aquatots will provisionally hold a place at the agreed time and pool site for 7 days only (unless otherwise advised) whilst awaiting your booking documentation and payment to arrive. If we are not in possession of your completed booking documentation and payment within the deadline, the provisionally held place will be made available to others.

Booking procedures.
Babies must be aged 10 weeks and 10lbs (4.5kg) in weight and under 18 months to start on the Aquatots Programme.

To ensure that the booking is processed correctly:

  1. When making a provisional booking, please take note of the pool site, and all relevant dates and times of the requested session(s). At this time, unless otherwise informed you will be given a 7- day deadline within which you are to return your completed booking documentation.
  2. Please read the terms and conditions before completing and returning any Aquatots booking documentation.
  3. Ensure all relevant fields on the booking form, one per child, are completed and signed, failure to do so will mean that we are unable to process your booking.
  4. Enclose a cheque, one cheque per child, (with child''s name on the reverse side). Sign and date the cheque(s), as failure to do so will mean that we are unable to process your booking.
  5. Use the pre-addressed envelope enclosed, to return your completed booking form, Assumption of Risk Agreement and cheque(s) to Aquatots, to be received within the given 7- day deadline.

Re-booking procedures.
Prior to the end of your current term your Aquatots teacher will inform you of the expiry date for the placement provisionally held for you for the forthcoming term (subject to the next level been available at your current pool). To ensure your re-booking is processed correctly, please follow the booking procedures as set out in these terms and conditions or as advised of in any amendments.

Booking documentation not completed as per the rebooking procedures, including but not limited to; two or more children on one booking documentation. More than one child on same cheque and any other payment included on course fee cheque other than the course fee,- will jeopardize the confirmation of the booking as these documents will be returned to you to be correctly completed.

The given re-booking deadline and the consequences for not returning the booking documentation correctly completed will stand, even if Aquatots returns any documentation to you to complete as required by the terms and conditions. The onus will be on you, the customer to confirm your provisionally held place and return your completed booking documentation and payment prior to the given expiry date.

Parental/Guardian Assumption of Risk Agreement.
You must read and sign the Assumption of Risk Agreement, one per child, and return to Aquatots with your booking form(s) and cheque(s). Failure to complete and sign the Agreement will mean that we are unable to process your booking.

Completion of Agreement.
Your agreement with Aquatots exists for the duration of the booked term or advised extension to that term. A new agreement will be formed for each new term booked in line with our booking procedures and current terms and conditions.

Aquatots withdrawal from the Agreement.
Aquatots reserves the right to withdraw from the agreement at no financial loss to Aquatots, if the information you have provided on the booking documentation or any time during your Aquatots term is proven to be deliberately misleading or factually incorrect, or where there is a serious and or continuous breach of national or local health and safety requirements/policy and/or the Aquatots Code of Conduct.

Aquatots will not enter into a binding agreement with persons under the age of 18.

If you wish to amend the booking.
If, following the receipt of your booking documentation, or having been in receipt of, written confirmation of your booking, or following the start of the term, you wish to amend any part of your booking, Aquatots, although willing to consider any reasonable requests, are unable to guarantee to accommodate any or all such amendments.

If we amend the booking.
Aquatots reserves the right to amend any previously advertised or scheduled session(s). If we have to amend the booking, you will be advised at the earliest opportunity of these changes.

Where there are insufficient numbers to make the session(s) viable these will be withdrawn and you will be advised at the earliest opportunity of these changes and if available, offered alternative days, times and location or a refund in line with these terms and conditions.

Administration charges for pre term cancellation.
On confirmed bookings cancelled up to 14 days prior to the start of a term, an administration charge of £15 will be levied.

Cancellations made between 14 days and the confirmed term start date, an administration charge of £20 will be levied. Administration charges will be deducted from agreed refund before the refund is forwarded to you. No administration charge will be levied where notification of cancellation is made before Aquatots have confirmed the booking.

Administration charge for Bank returned cheques.
On cheques returned to Aquatots by a bank marked Refer to Drawer there will be an administration charge of £10 per cheque levied. The payment of this charge is to made separate to the amount on the referred cheque, either in cash, postal order or cheque made out to ''AQUATOTS'' and should be returned at the same time as the replacement payment for the amount on the ''referred'' cheque.

Cancellations, Refunds & Credits.
Aquatots pool sessions and teachers are contracted for the term in advance. We are therefore unable to refund any monies for sessions missed because of general illness to either parent/guardian or child, holidays confirmed prior to or taken during the term or for missed sessions because of late arrival or non-attendance (voluntary withdrawal).

Following the start of the term a pro rata refund may be considered if Aquatots have interest shown on a waiting list for the day, time and venue to be vacated. The refund awarded under this circumstance would normally be for six sessions as Aquatots are unable to accept any one later than week three of the term.

If a current Aquatots customer on the same level and term week has expressed a willingness to move from their current day and or time to the place you wish to withdraw from, any refund will then be pro rata from the date the replacement occupies the vacated slot.

There maybe circumstances beyond our control and contemplation, in which the pool might not be available for Aquatots session(s). Examples of these circumstances include (but are not limited to) damage to the pool, severe weather conditions, power failures, industrial action. Such circumstances are referred to as ''Force Majeure''.

Where a session(s) are cancelled due to the unavailability of a facility or teacher Aquatots will endeavour to provide additional session(s) make up class(es) within the scheduled term. Where Aquatots are unable to arrange the additional session(s) your account will be automatically credited the appropriate pro rated amount for the forthcoming term.

Refunds for withdrawal on medical grounds.
If you wish to withdraw from the agreement on medical grounds a letter from your GP, Consultant or Specialist shall be required, confirming the child should not swim, along with your written notification of withdrawal and if applicable a request for refund, which you need to forward to the Aquatots Accountants Dept.

A refund where agreed, shall be pro rated for the balance of sessions remaining from the date of the receipt, of your written notification and written confirmation from your GP, Consultant or Specialist. Where a letter from your GP, Consultant or Specialist arrives with or within 7 days of your written notification the refund, where agreed will be pro rated from that date. Where the letter from your GP, Consultant or Specialist arrives after the 7 days of your written notification, the refund where agreed, will be pro rated from the date Aquatots received the GP''s, Consultant or Specialist letter confirming that the child should not swim.

All refunds, will be made following the end of the relevant term.

Customer Services.
Aquatots is committed to providing a high quality of service and we continually monitor our existing performance and procedures so as to improve our service provided to our customers. Your complaints/ suggestions will be handled in the strictest confidence.

If you have any complaints about any part of the service you have received following the start of your term, you should initially bring these to the attention of your teacher as they may be best placed to advise or rectify the problem.

If having informed your teacher you remain dissatisfied, or your complaint relates to the teacher or to the service provided by Aquatots prior to or during the term you should forward your complaint in writing to:

Aquatots Customer Service Department aims to acknowledge your complaint within 14 working days of receipt of your correspondence and issue a full response within 28 working days of receiving your correspondence.

If we are unable to provide a full response within 28 working days, we will inform you at what stage we have reached in the handling of your complaint. It will help us immeasurably, with your complaint if you can provide as much background information as possible.

Communicating with you.
Where you have provided Aquatots with an e-mail address on your booking form this may be used to expedite the communication of any amendments or information relevant to your booking. The onus will be on you the customer to access the e-mail account you have supplied Aquatots on a regular basis.

If you do not provide us with an e-mail address all such information will be dispatched to you by post and or communicated by telephone. The onus will be on you the customer to access your answer phone or message service on a regular basis.

Data protection Policy.
Aquatots Privacy Policy complies with the Data Protection Act 1998. We will not knowingly make available any personal information that we hold about you to any person(s) not directly responsible for or connected with the servicing of your booking.

Under the act, you are entitled to a copy of the personal data that we hold. This can be forwarded to you upon receipt of your written request and when Aquatots are satisfied with the legitimacy of said request.

Copyright.
The copyright for the content, text , graphics, photographs, photographic negatives, or images captured on video, film or digital medium belongs to and remains the property of Aquatots.

Aquatots further reserve the right to use images and media for advertising purposes within the scope of Aquatots news bulletins and media promotions, unless we receive in writing requests expressing your desire for us not to do so.

Access to any of the aforementioned does not imply a license to reproduce, adapt or distribute. Any such act without prior written consent from Aquatots Ltd. would constitute a breach of the Copyright Designs and Patents Act 1988.

 

Amendments to Terms & Conditions.
Aquatots reserves the right to amend its booking terms and conditions and associated documentation at any time.

Severability.
If any provision in these terms and conditions should be held to be invalid it shall to that extent be severed and the remaining provisions shall continue to have full force and effect.

Statutory Rights.
These terms & conditions do not affect your statutory rights.
